Stories, ideas, suggestions, essays, audio, video, photographs or related materials and any other materials of any kind whatsoever submitted (collectively, the "Submissions") will not be returned or kept confidential. By providing the Submission(s), you represent and warrant that: (i) you are a legal US citizen age eighteen (18) years or older, (ii) that your Submission(s) and any ideas contained therein are original to you and have not (in whole or in part) been previously published, (iii) that your Submission(s) does/do not contain any materials which would violate or infringe upon the rights of any third party, including copyrights, trademarks, rights of privacy or publicity, music piracy, property rights, etc. All Submission(s) may be used: (i) on www.oprah.com (the "Website"); (ii) for broadcast or other publication by Harpo, Inc. or any of its affiliated companies or entities, including, but not limited to, Harpo Productions, Inc., OWN: The Oprah Winfrey Network ("OWN") and Oprah & Friends, Inc. (collectively "Harpo") or its related and/or affiliated companies or entities, including without limitation, The Oprah Winfrey Show, "The Oprah Winfrey Network" and distributed worldwide in all markets and media, now known or hereafter created, in perpetuity. By making a Submission(s), you acknowledge and agree to the terms and conditions below and you consent to your name and geographic location possibly being published in connection with the publication, distribution and/or broadcast of your Submission(s). For Submissions containing minors: (a) your Submission must contain, the minor(s)’s name(s) and date(s) of birth, and the minor(s) address, if not the same as yours; (b) you warrant and represent that, for every Submission made by you containing a minor(s), you are the legal guardian with the sole legal authority to agree to these terms and conditions on behalf of (all of) said minor(s) and that no laws, Court orders or reasonable standards of care have been violated in the creation of your Submission(s). If your Submission(s) is/are selected for further use, you may be asked to provide proof sufficient in Harpo’s sole discretion that you meet the requirements of (a) and (b) above (i.e. you may be asked to provide (a) birth certificate(s); relevant court judgments, etc…).
Terms and Conditions you agree to by making a Submission(s):
1. The Submission(s) may be shared with and/or used by the staff, producers and/or developers of The Oprah Winfrey Show, the Website, Harpo (or its related and/or affiliated companies or entities, including, without limitation, OWN), as well as any third parties Harpo may elect.
2. Neither Harpo nor any of its affiliated companies or entities are obligated to use the Submission(s) or pay you for any Submission(s) and the use of any Submission(s) is at Harpo’s sole artistic and other discretion.
3. It is possible that similar Submissions may be submitted to Harpo by multiple sources and that a Submission may be similar to ideas generated or developed independently by Harpo employees.
4. All Submissions: (i) shall become the property of Harpo, (ii) may be edited for length, clarity and/or functionality, (iii) will not be subject to any obligation of confidentiality, (iv) may be shared with and used by the staff of Harpo and any of their affiliated companies or entities, and (v) shared with legal authorities if Harpo believes it warranted, as determined in its sole discretion. Neither Harpo nor any third or other party with whom Harpo shares the Submissions shall be liable for any use or disclosure to a third party of any Submissions or information contained therein.
5. Harpo shall exclusively own and administer 100% of the copyright in all Submissions, including all known or later existing rights, and shall be entitled (but not obligated) to unrestricted use, assignment and/or licensing of the Submissions for any purpose worldwide, in all media now known or hereafter created, in perpetuity without compensation to the provider and/or owner/creator(s) of such Submissions.
6. Harpo reserves the right to change due dates for Submissions, or other specifics, as it deems necessary in its sole and exclusive discretion.
7. No Submission may contain any material that is abusive, vulgar, threatening, harassing, libelous, defamatory, obscene, invades a person's privacy, violates any intellectual property or other property or other rights, is known to be false or that would otherwise violate any law(s).

8. If the Submissions contain photos, you represent and warrant that such photos were not
professionally shot and that you own all rights and interests (including copyright) in the photos.
9. If your Submission contains music, please avoid any “popular” and/or copyrighted music
(including instrumentals) and karaoke recordings in your submissions. A cappella or self-accompanied versions of public domain or original songs are strongly recommended. You may visit http://www.pdinfo.com/list.htm for a list of public domain songs. If “popular”, copyrighted or karaoke music is unavoidable, please provide the following information along with your video Submission: Accurate Song Title, Recording Artist , Song Writers Record Label (if applicable - please check the credit information on iTunes or the back of the CD cover)
10. You, on Your own and on behalf of any minor who may be the subject matter of any Submission you are submitting, hereby release Harpo from any loss, claims or injuries You may incur arising out of Your Submission and/or Harpo’s use thereof, including, but not limited to, claims of emotional distress based upon any viewer comments from Harpo’s posting of the Submission(s).
